Safety Terms, Customer Waiver and Cancellation Policies. 

Below are the terms which apply to all Participants upon booking with Around The Basin Bike Queenstown.
Upon making a booking the Participant agrees to be bound by these booking terms. 

There are inherent risks, dangers and hazards in adventure activities, which includes cycling, mountain biking and hiking. We will endeavour to make your trip as safe as possible, but not all risks, dangers and hazards can be anticipated or avoided. You are expressly assuming those risks personally and are, to the maximum extent permitted by law, releasing the Operator (Around The Basin), its officers and employees from any liability, claims, losses, damages or expenses caused by any event including, but not limited to:

           • Personal injury or death

           • Property loss or damage

           • Acts which may be construed as negligent or accidental

           • Any other loss, damage, suffering, emotional or nervous disorder

 

1 –    Customer Waiver and Participation Agreement

a) In participating in the activity I, the customer, agree to the conditions set out as above and consent to the conditions in clauses 1 to 12 here.

b) I agree that my successors, executors, administrators and next of kin are bound by the terms and conditions.

c) I agree not to commence any litigation or proceedings in any country in relation to the risks and perils set out in the points above and to indemnify the Operator against any such claims.

d) I confirm that I am physically fit and suffer no medical conditions, which may be aggravated by this activity.

e) I confirm that I am capable of riding on varied terrain, some of which crosses suspension bridges and passes along high river gorges.

f) I consent to receive medical treatment in the case of injury, accident or illness during the activity and to indemnify the Operator against any claims in respect of this treatment.

g) I agree that any films, sound, video or other recordings taken of or during the activity will not be used in any promotion or advertising without the prior consent of the Operator. The Operator may use such recordings itself at its complete discretion without any prior approval.

h) I agree to listen to my driver/guide, follow their instructions and make sure any children in my care do the same.

i) I agree to wear the provided helmet at all times while riding.

2 – Any vouchers issued by an agent for the Operator are non-transferable.

3 – The selling agent and or Operator accept no responsibility for any loss or additional expenses arising from changes, delays or cancellations of the services and activities of the Operator.

4 – This voucher is based on fares and tariffs, which are, to the best of the Operators knowledge, correct at the time of issue. Any increases since the date of issue are at the cost of the passenger payable to the Operator.

5 – Cancellations by the Operator

a) The Operator reserves the absolute right to cancel any service as a result of weather conditions, insufficient reservations or any other unforeseen event or circumstances – a booking re-scheduling or refund (less 3% transfer fee) will be arranged.

6 – Cancellations due to Weather

a)  If weather is unsuitable for riding (heavy rain or snow), weather calls are made on the day of your booking. Please call 1 hours prior to tour departure to discuss options.

b) If you wish to cancel on the day due to weather, we can reschedule you to another day or a refund will be issued less a 10% admin fee.

c)  If you are a large group who have paid a non refundable deposit, this will not be refunded.

The following cancellation policies apply if you have booked directly through Around The Basin.
If your booking is through a Third-Party Agent, then please refer to them for cancellation guidance.

7 – Cancellation or Modification by the Customer – Single Day Ride Options

a) 1 – 5 Participants – Up until 24 hours prior to the time of activity I, the customer, may change or cancel the booking. The exception to this is a black out period from December 18th to January 18th where 72 hours notice must be given for a refund. Any changes should be made directly with the Operator. Cancellations made within 24 hours prior to the activity departure will not be refunded.

b) Groups of 6 – 14 Participants – Up until 7 days prior to the day of activity I, the customer, may change or cancel the booking before full charges apply. The exception to this is a black out period from December 18th to January 18th where 14 days (2 weeks) notice must be given for a refund. I agree to pay a 10% non-refundable deposit to confirm the booking, with the remaining balance due 7 days prior to the activity.

c) Groups of 15 or More Participants – Up until 14 days (2 weeks) prior to the time of activity I, the customer, may change or cancel the booking before full charges apply. The exception to this is a black out period from December 18th to January 18th where 21 days (3 weeks) notice must be given for a 50% refund. I agree to pay a 10% non-refundable deposit to confirm the booking, with the remaining balance due 4 weeks prior to the activity.

d) If a booking is cancelled on the day by the Operator due to unsuitable conditions, a refund (less any non-refundable deposit and a 10% admin fee) will be given, if re-scheduling is not an option.

e) In the event that a prepaid reservation is not utilised by the customer without any notification to the Operator, no reimbursement will be given. “No-shows” will be charged at full activity price, and “late arrivals” (that miss scheduled departure times) will forfeit their booking and be charged in full.

f) A rescheduling fee will be charged if a change is made within 24 hours of the original booking.

8 Cancellation or Modification by the Customer – Multiple Day Ride Options

a) 1 to 9 Participants – Up until 72 hours prior to the first day of activity I, the customer, may change or cancel the booking before full charges apply. I agree to pay a 25% non-refundable deposit to confirm the booking, with the remaining balance due 7 days prior to the first day of activity.

b) Groups of 10 or More Participants – Up until 14 days (2 weeks) prior to the first day of activity I, the customer, may change or cancel the booking before full charges apply. I agree to pay a 25% non-refundable deposit to confirm the booking, with the remaining balance due 14 days (2 weeks) prior to the first day of activity.

c) In the event that a pre-paid reservation is not utilised by the customer without any notification to the Operator, no reimbursement will be given. “No-shows” will be charged at full activity price, and “late arrivals” (that miss scheduled departure times) will forfeit their booking and be charged in full.

d) A rescheduling fee will be charged if a change is made within 24 hours of the original booking.

9Refunds

a) The Operator reserves the right to assess cancellations on a case by case basis and any decision on refunds is entirely at the discretion of the Operator.

b) A admin processing fee of 10% will apply to all bookings that are refunded.

10 – I agree that any decision regarding an exception to the stated policy will be made entirely at the discretion of the Operator. 

11 – Damage to Bike(s) or Equipment – I agree to return any bike(s) or equipment hired from the Operator in an undamaged condition. Any damaged parts or components may be repaired or replaced, at the Operator’s discretion, and I will be liable for these costs and charged at retail rates.

12 – COVID-19 If due to the Governments COVID-19 Protection Framework (Traffic Light System) I am unable to participate in an activity due to regional travel restrictions, I must notify the Operator 24 hours prior to the booking to re-schedule or alternatively receive a full refund. If I fail to do so, I will be charged in full. 

Note: A merchant processing fee of 10% will apply to bookings that are refunded.

Privacy Policy

This Privacy Policy governs the manner in which Around The Basin collects, uses, maintains and discloses information collected from users (each, a “User”) of the website (“Site”). This privacy policy applies to the Site and all products and services offered by Around The Basin.

 

Personal Identification Information

We may collect personal identification information from Users in a variety of ways, including, but not limited to, when Users visit our site, register on the site place an order subscribe to the newsletter and in connection with other activities, services, features or resources we make available on our Site. Users may be asked for, as appropriate, name, email address, mailing address, phone number, credit card information, Users may, however, visit our Site anonymously.

We will collect personal identification information from Users only if they voluntarily submit such information to us. Users can always refuse to supply personally identification information, except that it may prevent them from engaging in certain Site related activities.

 

Non-Personal Identification Information

We may collect non-personal identification information about Users whenever they interact with our Site. Non-personal identification information may include the browser name, the type of computer and technical information about Users means of connection to our Site, such as the operating system and the Internet service providers utilised and other similar information.

 

Web Browser Cookies

Our Site may use “cookies” to enhance User experience. User’s web browser places cookies on their hard drive for record-keeping purposes and sometimes to track information about them. User may choose to set their web browser to refuse cookies, or to alert you when cookies are being sent. If they do so, note that some parts of the Site may not function properly.

 

How we use Collected Information

Around The Basin collects and uses Users personal information for the following purposes:

  • To improve customer service.
  • Your information helps us to more effectively respond to your customer service requests and support needs.
  • To improve our Site.
  • We continually strive to improve our website offerings based on the information and feedback we receive from you.
  • To process transactions.
  • To send periodic emails.

We may use the information Users provide about themselves when placing an order only to provide service to that order. We do not share this information with outside parties except to the extent necessary to provide the service.

The email address Users provide for order processing, will only be used to send them information and updates pertaining to their order. It may also be used to respond to their inquiries, and/or other requests or questions. If User decides to opt-in to our mailing list, they will receive emails that may include company news, updates, related product or service information, etc. If at any time the User would like to unsubscribe from receiving future emails, we include detailed unsubscribe instructions at the bottom of each email or User may contact us via our Site.

Payments are processed through the secure DPS Payment Express system. Any credit card payments are done so on the DPS system. No credit card information is stored by us and we are PCI compliant. Payments must be received prior to orders being shipped. The name that will appear on your statement will be Around The Basin.

 

How we Protect your Information

We adopt appropriate data collection, storage and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of your personal information, username, password, transaction information and data stored on our Site.

Sensitive and private data exchange between the Site and its Users happens over a SSL secured communication channel and is encrypted and protected with digital signatures.

 

Sharing Your Personal Information

We share your Personal Information with third parties to help us use your Personal Information, as described above. For example, we use WordPress and Woocommerce to power our online store. Around The Basin has the discretion to update this privacy policy at any time. When we do, revise the updated date at the bottom of this page,. We encourage Users to frequently check this page for any changes to stay informed about how we are helping to protect the personal information we collect. You acknowledge and agree that it is your responsibility to review this privacy policy periodically and become aware of modifications.
